Bilazora Holdings LLC ("Digitiva Hub," "we," "our," or "us") operates the sales platform located at www.digitivahub.com ("the Sales Platform"), which enables customers to purchase digital products, including software, media, templates, or other goods (collectively, "Products") from Vendors. Additionally, third-party advertisers ("Affiliates") may promote these Products on behalf of Vendors and Digitiva Hub.

By accessing, purchasing, selling, or using the Sales Platform, you ("User") confirm that you have read, understood, and agree to comply with the following terms and conditions ("Agreement").

1. Understanding Digitiva Hub as a Marketplace

Digitiva Hub provides a venue for Vendors to list their digital products and for Affiliates to promote these listings. We facilitate transactions but are not part of the direct sales transaction between Buyers and Vendors. By using Digitiva Hub, you acknowledge the following:

  1. Independent Transactions:
    • Purchases made on the platform are between Buyers and Vendors. Digitiva Hub does not own or control the listed Products.
  2. Vendor Responsibility:
    • Vendors are responsible for ensuring the accuracy of product descriptions, compliance with all applicable laws, and adherence to stated refund policies.
  3. Affiliate Responsibility:
    • Affiliates may only promote Products listed on the Sales Platform and are subject to performance-based commissions, as outlined in the Affiliate Agreement.
  4. Limited Liability:
    • Digitiva Hub does not pre-screen listings and is not responsible for the accuracy, quality, or legality of Products sold on the platform.

2. Purchasing Products on Digitiva Hub

When making a purchase, you agree to:

  1. Review Details:
    • Read the product description, pricing, and applicable Vendor policies before purchase.
  2. Provide Accurate Information:
    • Ensure that the billing and shipping information provided is correct.
  3. Accept Vendor-Specific Policies:
    • Each Vendor may have unique terms regarding refunds, returns, and delivery.
  4. Adhere to Payment Terms:
    • Payments must be processed through Digitiva Hub’s checkout system, which uses secure third-party payment processors like Stripe and PayPal.

3. Payments and Processing

Payment Methods: Digitiva Hub supports various payment methods, including:

  • Major credit/debit cards
  • PayPal
  • Bank transfers
  • Digital wallets like Apple Pay and Google Pay

Third-Party Terms: By using a third-party service, you agree to their specific terms, such as:

  • Stripe: Stripe Checkout User Terms
  • PayPal: PayPal User Agreement

Transaction Security: Digitiva Hub employs secure encryption technologies to protect your payment information.

4. Vendor and Affiliate Responsibilities

Vendors:

  • Vendors are solely responsible for the accuracy, legality, and fulfillment of their listings.
  • Vendors must adhere to applicable laws, including tax regulations, and provide clear refund policies.

Affiliates:

  • Affiliates promoting Digitiva Hub listings must comply with all advertising standards.
  • Affiliates earn commissions based on performance metrics detailed in the Affiliate Agreement.

5. Refund and Cancellation Policies

Refund Requests: Refunds may only be requested within 7 days of purchase.

  • Customers dissatisfied with a product must submit a refund request directly to Digitiva Hub within the 7-day window.
  • Refund requests submitted after the 7th day will not be processed, and Digitiva Hub will not mediate disputes for these transactions.

Eligibility for Refunds:
Refund requests are subject to review and approval based on the following criteria:

  • The product was not downloaded or accessed.
  • The customer demonstrates dissatisfaction within the first 7 days of purchase.

Non-Refundable Scenarios:

  • Requests submitted after the 7-day refund period.
  • Issues unrelated to the product description or usage.

Refunds are processed via the original payment method. If unavailable, Digitiva Hub credits may be issued.

6. Content Creation and Reviews

User-Generated Content:
Users may submit reviews, upload content, or leave feedback. By doing so, you agree that:

  • Your content does not infringe on third-party intellectual property rights.
  • Your content is respectful, honest, and free of false claims.

Digitiva Hub reserves the right to remove content violating these guidelines.

7. Non-Delivery and Not-As-Described Products

Non-Delivery Cases:
A product is considered "non-delivered" if:

  1. No valid proof of delivery is provided.
  2. The product was not sent to the Buyer’s provided address.

Not-As-Described Cases:
Products are eligible for disputes if they differ significantly from their listing, including:

  • Incorrect color, model, or quantity.
  • Misrepresentation of condition or authenticity.

Disputes are resolved per Vendor policies or at Digitiva Hub’s discretion.

8. Intellectual Property and Licensing

All content on Digitiva Hub, including text, graphics, and software, is protected by intellectual property laws. Users may not copy, distribute, or modify any materials without explicit permission.

9. Limitations of Liability

Digitiva Hub is not liable for:

  • Vendor misconduct or inaccuracies in product listings.
  • Delays or issues caused by third-party payment processors.
  • Loss or damage arising from unauthorized access to user accounts.

10. Termination and Account Suspension

Digitiva Hub reserves the right to suspend or terminate user accounts for:

  • Violation of these Terms.
  • Fraudulent or abusive behavior.
  • Non-compliance with payment obligations.

11. Changes to Terms and Conditions

We may update these Terms at our discretion. Changes will take effect upon posting to the Website. Continued use of the platform signifies acceptance of revised Terms.

12. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the United States and the State of New Mexico. Any disputes arising from these Terms will be resolved through binding arbitration, except where prohibited by law.
